'DIRECTIVES FOR THE USE OF AWERReviews.com These guidelines (the 'Guidelines') apply to any use of AWER Reviews S.A. websites by our community, such as AWERReviews.com and similar sites ('our Website'). Throughout the Guidelines, we will refer to users of our Website as 'you' and 'your'. The use of our Websites by companies is governed by AWERReviews S.A.'s Business Guidelines. When can a review be written? 1.1 You may write a review about a company if you have had a purchasing or service experience with that company, which means: you have purchased a product or service from a company, an organization, a web service, etc. ('the Company'), or you have placed an order with the Company, or you can provide documentation that you have used the services of the Company, including correspondence or other interactions with the Company. (the above points will be referred to as 'Service Experience' in the following lines.) 1.2 You may only write about your own personal Service Experience. You should not write a review about someone else's Service Experience, for example, a family member or a friend. 1.3 You may not write a review about a Company that you have owned in the past, currently own, or is owned by one of your immediate family members. You also cannot write a review if you are an executive or employee of such Company or work for the Company. Similarly, you may not write a review about a direct competitor of a Company that you own, are employed by, or work for. 1.4 Your Service Experience with the Company must have taken place within the last twelve (12) months from the date of writing the review. If you are subscribed to a continuous service, the Service Experience begins immediately upon your subscription and continues until the Company ceases to provide the service. You can write a review immediately after your subscription, at any time during the period of time you use the services, or within the immediate twelve (12) months after the end of the service. 1.5 To write a review on AWERReviews, you need a profile and a user account. You may only have one (1) profile and one (1) user account. They must be linked to a valid email address that we can use to contact you directly. 2 What should you write about? 2.1 Your review should address your Service Experience. 2.2 Your review should reflect your own Service Experience, which took place within the last twelve (12) months. You are encouraged to provide details and stick to the facts about your Service Experience in general. For example, customer service or other aspects such as the order process and delivery. 2.3 Our Website focuses on reviews about the service, not product reviews or reviews about the design of the website. However, it is acceptable to evaluate the functionality and quality of the purchased product and/or the ease of use of the website, as long as your review also comments on your Service Experience. 2.4 If the Company has offered you an incentive to write a review, you should include information about it in your review. Incentives include the Company offering you a gift, reward, discount, or advantage for writing a review about the Company on our Website. 3 When do we ask you to provide proof of your Service Experience and what should you send us? If we need to verify your opinion, we may contact you to request documentation that demonstrates that you have had a Service Experience with the Company that is the subject of your opinion. Therefore, we recommend that you keep such documentation for twelve (12) months from the date of your opinion. We do not share the documentation you send us with third parties, including the Company that is the subject of the opinion. However, if appropriate, we may transfer your reference number to the Company, unless you ask us not to. Our Privacy Policy details how we handle your personal information, including the documentation you send us. 4 When can you modify your opinion? You can update or modify your opinion at any time. To do so, you must contact support@awerreviews.com and justify the reason for the update or modification. 5 When will we ask you to modify your opinion? 5.1 We do not censor, monitor, or moderate opinions on our Website, either before or after they are published. However, we implement two series of safeguards: We run automatic checks on certain content that is not allowed in opinions, such as offensive language and certain links. We have integrated two notification options on the Website regarding each opinion: (1) users can send us notifications regarding opinions that do not comply with our Guidelines, and (2) companies can report that an opinion does not comply with our Guidelines. Together, these two notification and reporting options are called 'Alerts'. 5.2 You may be asked to modify your opinion if you have been the subject of a warning (Alert) for any of the following reasons and we agree or cannot dismiss the report as unfounded: - Your opinion contains insulting language and is likely to be provocative, includes defamatory statements, or otherwise violates our Guidelines or applicable laws - Your opinion contains violent or vulgar language, or has a sexist or racial character - The content of your opinion appears to be solely focused on an ethical, political, and/or clearly connoted value opinion, rather than focusing on a Service Experience - Your opinion includes personal information about another person, such as their name, address, telephone number, email address, credit card information, or any other data about another person that could be used to locate, identify, contact, or impersonate them - Your opinion includes promotional references (including links) to other companies and websites that are not related to your Service Experience - Your opinion contains personal email addresses or links, or - Your opinion is not an opinion about your Service Experience because it exclusively describes the functionality of the purchased product or website design. In what cases can we remove your opinion? As a general rule, we do not remove opinions from our Website. However, we reserve the right to remove opinions that we conclude breach these Guidelines, our Terms* and/or applicable laws or regulations, or opinions that are inappropriate for an online opinion community. The following are examples, merely illustrative, of situations in which we may remove your opinion: - We ask you to modify your opinion and you do not do so within the indicated period. - We ask you to provide us with documentation that justifies the Service Experience you have had with the Company object of the opinion (in accordance with clause 3) and you do not provide sufficient documentation within the indicated period. - Your opinion does not appear to be based on an authentic Service Experience (e.g., it is a fabricated opinion, see clause 11 below). Your opinion relates to a tax or fine. Your opinion contravenes the rights of other individuals or companies, including intellectual property rights, privacy/confidentiality rights, and/or personality rights. Your opinion is commercial in nature or has commercial purposes. You are, or work for, a competitor of the Company object of your opinion. You are an employee of (or work for) the Company object of your opinion, you are or have previously been the owner of the Company, you are an executive of the Company or a direct family member of the owner of the Company. Multiple profiles have been created to post multiple opinions about the same Company. If we have to delete your user profile (see clause 8 below), by default, your opinions linked to that profile will also be deleted. In what cases can we block your account and what does it mean? We may block your account if you misuse our Website or services. This includes, merely illustratively, excessive use of the notification option (notifying (Alerts) a high number of opinions without justification), drafting fabricated opinions, threatening or abusive behavior (see clause 12 below), unwanted posting of marketing material on our Website, or failure to comply with these Guidelines or our Terms and Conditions. If we block your account, you will not be able to log in to our Website or use our services, including writing opinions and reporting to us about others. Your user profile will still exist, and your opinions will remain online, but you will not be able to use our services. If your account is blocked and you want to delete your profile or reviews, you can send us an email to support@awerreviews.com and we will take care of your request. Under what circumstances do we delete your profile and user account? As a general rule, we do not delete profiles and user accounts. However, we reserve the right to delete your profile and account if we believe that you are in violation or have violated our Terms and Conditions, Guidelines, and/or applicable laws, or if your profile is offensive or inappropriate. The following are examples, for illustrative purposes only, of situations in which we may delete your profile and user account: /n/nYou are not associated with a valid email address, which includes cases where the email address provided has expired or you no longer have access to it. We require you to subscribe to our services with a personal, valid, and permanent email address, as we may need to contact you. This means that we do not accept the use of temporary or disposable email addresses. If you have used such an email to create an account, we will delete your profile and user account. Your user profile contains an offensive or inappropriate image or username. Your user profile or account has been used to create fake reviews or has otherwise misused our website or services. You have created multiple user profiles. You can only have one user profile on AWERReviews.com. If you create more than one user profile, we will ask you which one you want to keep and delete the others. If you do not respond within the specified time frame, we will delete all but one of your profiles, at our discretion. If your profile and user account are deleted, the reviews associated with that profile and user account will also be deleted. 9 Misuse of the notification function All AWERReviews users can notify us about reviews that violate these Guidelines (or applicable laws). However, we consider the misuse of the notification function to be a serious breach of our Terms and Conditions. The following are examples, for illustrative purposes only, of misuse: Incorrectly or falsely notifying all or many of the positive reviews of a Company with which you have had a negative service Experience; Incorrectly or falsely notifying all or many of the negative reviews of a Company with which you have had a positive service Experience, or with which you have a special relationship; or Notifying us of the same review multiple times after it has been evaluated and determined to be in compliance with our internal quality process, except in certain exceptional circumstances. /n/n10 When do we move your review from one company profile to another? As a general rule, we do not move reviews from one company profile to another. However, if the Company or another user notifies us that your review has been placed on the wrong company profile, we will ask you which company you intended to review. If you have posted your review on the wrong company profile, we will move your review to the correct company profile page on our website. We also reserve the right to move your review from one company profile page to another in special circumstances and to avoid confusion, such as when a company changes its trade name. 11 Fake reviews Our goal is to create and maintain a high-quality online community of reviews where you can freely share your service Experiences with the Company and provide an informative and fair view of the Company's services. We use advanced and customized detection software to identify fake reviews on our platform. To support the software, we have a specific Compliance Team that ensures trust by protecting our platform against fake reviews and other misuses of the service, as well as fighting fraudulent behavior. We have a zero tolerance policy against invented opinions. Trust is crucial to us and under no circumstances can we accept invented opinions. These consist of opinions that are not the expression of an authentic service experience, for example because they are created by or on behalf of the Company. We consider the creation of invented opinions a serious breach of the Terms and Conditions that you accept when creating your user profile and account on our website. Opinions that we consider to be false, invented, or similar will be removed and may lead to the immediate blocking of your account and the filing of a complaint with the relevant authorities. We also reserve the right to inform our community about any domain subject to opinions on AWERReviews.com that has attracted a large number of invented opinions. If you have evidence that an opinion is invented, we encourage you to notify us through our alert function by sending an email to: support@awerreviews.com. We take all reports of invented opinions seriously and investigate them thoroughly. As this is not an easy task, we ask that you provide us with all the information possible, including documentation that justifies your impression that an opinion has been invented. /n/n 12 Threats against employees and companies of AWER Reviews S.A. We do not accept threats or abuse against AWER Reviews S.A. employees. Additionally, we do not tolerate threats or blackmail against other companies by our users. This includes users who request monetary compensation in exchange for modifying or deleting their reviews on AWERReviews.com We cannot accept such behavior and consider it a serious breach of the Terms and Conditions accepted between each user and AWER Reviews S.A. This may result in the immediate blocking of your account by us and the filing of a complaint with the relevant authorities. 13 Compliance Our commitment is to provide companies and users with an open and impartial online experience. We work hard to maintain the integrity of our reviews community and the online reviews industry as a whole, fostering a culture of trust and transparency, and celebrating the fact that these companies and users use reviews to improve customer service levels and make the online sales environment fairer and more open for everyone. We reserve the right to demand compliance with these Guidelines if we observe any violations, or if applicable laws or regulations have been violated. The same applies if we observe conduct that we believe or suspect to be inappropriate. 14 Specifications and technical requirements AWER Reviews S.A. is not obligated, and will not be obligated, under any circumstances, to provide any equipment or software program for Users to access the website. Therefore, in order to use the website, You must have, at Your sole expense and cost, all necessary resources and/or equipment, whether computer-related or not, including telecommunications, determining, at Your own risk, the means of communication to be used, including communication protocols and, if applicable, third-party providers of the corresponding services. 15 System failures We are not responsible for any type of damage, harm, or loss that You may suffer due to failures on the Website, on the server contracted by AWER Reviews S.A., or on the Internet. Likewise, we will not be responsible for any viruses that may infect your devices as a result of accessing, using, or visiting the website or due to any data, files, images, texts, videos, or audio transfers contained therein. /n/n Therefore, You may not hold us liable or demand payment of any compensation or damages based on hypothetical damages that may eventually result from technical difficulties or failures on the Website or on the Internet. We do not guarantee continuous or uninterrupted access and use of the website and its contents, nor the availability and/or continuity of their operation. In case the website and/or any of its contents are not available due to technical difficulties or Internet failures or for any other circumstance, we will endeavor to restore it as quickly as possible, without any liability on our part. The website is property of AWER Reviews S.A. and is protected by laws and international treaties regarding copyright, trademarks, patents, industrial designs, and other intellectual property rights. By continuing to use the website or our services once we have published a new version of the Guidelines, you accept them. 19 Applicable Law and Jurisdiction AWER Reviews is governed in all its aspects by the laws in force in the Republic of Argentina. Any dispute arising from its existence, validity, interpretation, scope, or compliance shall be submitted to the Ordinary Courts of the Autonomous City of Buenos Aires and the proceedings shall be conducted in the Spanish language. For all purposes, the address at Grecia 3394 street, Autonomous City of Buenos Aires, is established as the domicile.
